§ 5085. Birth defects information system use

It shall be the responsibility of the council to:

(1) study the need for the creation of a comprehensive, integrated, and confidential birth information system to collect information on prenatal and postnatal conditions, special medical needs, and medical findings for infants and children up to six years of age, including stillbirths, pre-term births, and special medical needs;

(2) if needed, develop a plan for the creation of such a system, and identify specific goals and priorities of the system;

(3) if needed, develop a list of special medical needs to be reported as part of such a system;

(4) if needed, obtain accurate cost estimates for the creation and maintenance of such a system;

(5) if needed, assist the department of health in identifying sources of federal funding from the Centers for Disease Control and Prevention and other sources, if applicable, to develop and implement such a system;

(6) if needed, develop recommendations for data collection, data storage, and appropriate data uses that ensure the confidentiality of personally identifiable medical information, consistent with state and federal laws; and

(7) take testimony from a broad range of interested persons. (Added 2001, No. 87 (Adj. Sess.), § 3, eff. May 2, 2002.)
