2005 Vermont Code - § 3102. — Injuring or endangering traveler\'s person or property

§ 3102. Injuring or endangering traveler's person or property

(a) A person shall not:

(1) Wilfully and maliciously tamper with, displace, damage, or remove a railroad switch, track or bridge, or place an obstruction on such track or bridge; or

(2) Wilfully and maliciously display, hide or remove a signal or light upon or near to a railroad; or

(3) By any other wilful and malicious act or wilful and malicious omission to act, with reckless disregard for the safety of persons or property traveling or being upon such railroad, endanger or cause to be endangered, the safety of those persons or property.

(b) A person who violates a provision of subsection (a) of this section shall be imprisoned not more than two years. If in consequence of such violation a person passing over such railroad suffers serious bodily injury, the time of imprisonment may be lengthened, provided it does not exceed in all 10 years, except in the case provided in section 3101 of this title.
