§ 43. Method of taking
(a) A person may not take a fur-bearing animal by use of any poisonous mixture.
(b) A person shall not disturb or destroy a muskrat house or place a trap therein, thereon or at the entrance thereof, or in the entrance or inside a muskrat burrow.
(c) A person shall not take raccoons or foxes from holes or dens by cutting, digging, smoking, trapping, snaring or by the use of chemicals, or any mechanical device.
(d) A person shall not take skunks from holes or dens by cutting, digging, smoking, or by the use of chemicals.
(e) A person shall not interfere in any manner with dams, dens, or houses of beaver except upon special permit in writing from the commissioner, provided, however, that these provisions shall not apply to an owner of property, the agent, employee, tenant, or caretaker of the owner protecting the same from damage by beaver, or to the legislative body of a municipality or the agency of transportation, within their respective jurisdictions, when protecting public highways or bridges from such damage or submersion, with permission of the owners of lands affected, or to a person acting under authority of an order under section 37 of Title 19.
(f) A person shall not take raccoon by shooting except with a .22 caliber rimfire or #2 shot or smaller. (1961, No. 119, § 2, eff. May 9, 1961; amended 1963, Fish and Game Board Reg. No. -, eff.
