§ 4080d. Coordination of insurance coverage with Medicaid

Any insurer as defined in section 4100b of this title is prohibited from considering the availability or eligibility for medical assistance in this or any other state under 42 U.S.C. § 1396a (section 1902 of the Social Security Act), herein referred to as Medicaid, when considering eligibility for coverage or making payments under its plan for eligible enrollees, subscribers, policyholders, or certificate holders. This section shall not apply to Catamount Health, as established by section 4080f of this title. (Added 1993, No. 231 (Adj. Sess.), § 1; amended 2005, No. 191 (Adj. Sess.), § 17.)
