§ 2930. Refusal, suspension or revocation of license by commission
The commission may decline to grant, and after due notice and public hearing, may suspend or revoke a license for cause. Violation by a distributor of the provisions of this part hereof or any of the provisions or regulations pursuant to this part shall be sufficient cause to suspend or revoke a distributors license. In addition, after due notice and hearing, the commission may suspend or revoke a license already granted to a distributor, when satisfied of the evidence of any of the following facts:
(1) That he has committed any act which may demoralize the price structure of milk or interfere with an ample supply of milk for the inhabitants of the state;
(2) That he has engaged in a course of action such as to indicate his inability or unwillingness properly to conduct the business of a distributor;
(3) That he has been, or is, a party to a combination to fix or maintain prices contrary to any provision of this part;
(4) That he has engaged in a course of action so as to indicate an intent to deceive or defraud customers, producers or consumers;
(5) That he has failed either to keep records or to furnish the statements or information required by the commission under any provision of this part;
(6) That any statement made by a distributor and in reliance upon which, to any degree, his license was granted, has been found to have been false or fraudulent in any material particular;
(7) That he has failed to withhold and pay the fees required in section 2981 of this title. (1965, No. 175, § 74; amended 1991, No. 17, § 8(a), eff. April 4, 1991.)
