77-17-11. Jury to retire for deliberation -- Oath of officer having custody.
  • (1)After hearing the court's instructions and arguments of counsel, the jury shall retire for deliberation.
  • (2)An officer shall:
    • (a)be sworn to keep the jury together in some private and convenient place;
    • (b)not permit any person to speak to or communicate with the jury;
    • (c)not communicate with the jury except:
      • (i)upon the order of the court; or
      • (ii)to ask the jury whether the jury has agreed on a verdict; and
    • (d)return the jury to court when the jury has agreed and the court has so ordered, or when otherwise ordered by the court.
