2006 Utah Code - 70C-8-202 — Notification.
70C-8-202. Notification.(1) Parties subject to this part shall file notification with the department at least 30 days before commencing business in this state, and, thereafter, on or before January 31 of each year. All parties subject to this title which are extending credit to consumers on July 1, 1985, need not file an initial notification but shall file notification on or before the next January 31. The notification shall state:
(a) the name of the party;
(b) the name in which the business is transacted if different from that required in Subsection (a);
(c) the address of the party's principal office, which may be outside this state;
(d) the address of all offices or retail stores, if any, in this state at which credit is offered or extended to consumers, or in the case of a party taking assignments of obligations, the offices or places of business within this state at which business is transacted;
(e) if credit is extended to consumers other than at an office or retail store in this state, a brief description of the manner in which the credit transactions occur;
(f) the name and address in this state of a designated agent upon whom service of process may be made; and
(g) any other information deemed pertinent by the department.
(2) If information in a notification becomes inaccurate after filing, no further notification is required until the following January 31.
(3) A party which has not filed the notification and paid the fees required by this part may not extend any credit to consumers in this state until it has fully complied with the requirements of this part. Any party who willfully violates this subsection is guilty of a class B misdemeanor.
