17A-2-1822. Ratification of county service areas -- Bond issuance -- Amendatory proceedings.(1) This section applies to any county service area which has been created or purported to be created under Title 17A, Chapter 2, Part 4, County Service Areas, that becomes a regional service area as provided in this part.
(2) (a) Any proceedings that have been adopted by the board of trustees of the county service area for the purpose of authorizing bonds of the county service area, whether or not the bonds have been delivered, all proceedings had in connection with the creation of such county service area, the organization of its governing body, and all proceedings had in connection with the authorization of the bonds are validated, ratified, and confirmed.
(b) All bonds, when duly delivered and paid for as required by the proceedings, are validated, ratified, and confirmed and the bonds are declared to constitute legally binding obligations in accordance with their terms, notwithstanding any failure to comply with any one or more pertinent statutory provisions and notwithstanding whether such proceedings have been continuously in effect from the date of their adoption to the effective date of this part.
(3) (a) If bonds were authorized by a county service area but have not yet been issued, the governing body of the regional service area is authorized and empowered to do all things necessary to the issuance of such bonds and to the performance of the contracts of the county service area.
(b) Any actions performed and the bonds, when issued, shall benefit from the curative provisions of this section whether or not changes in the details of the bonds and in the proceedings authorizing their issuance have been made since their original adoption without regard to the nature of the changes.
(4) This section may not be construed to affect or validate any bonds, or the organization of any county service area, the legality of which is being contested at the time of conversion to a regional service area under this part.
