17A-2-523. Apportioning benefits.The benefits to such lands from constructing canals, drains, drain ditches and other works and maintaining the same; liquidating district warrants and notes and paying the interest thereon; paying the interest on the bonded indebtedness of the district; creating a sinking fund for redeeming such bonds; meeting all payments due or to become due or under any contract between the district and the United States; and for the purpose of maintaining and repairing drainage canals, flumes, conduits, bridges, culverts, and other works within such districts; and for the management and control of such drainage system and the taxes to be assessed, levied and collected for such purposes on said lands in any drainage district under said drainage laws shall be equitably apportioned among all lands held in private ownership, all lands covered by unpatented entries or contracts of purchase with the state of Utah, and all unentered or unsold state lands affected by such drainage system or drainage district; and officially certified lists showing the amount of the equalized benefits and taxes assessed against each smallest legal subdivision of such lands shall be furnished by the drainage district to the state land commissioner, or other proper officer of the state as soon as such benefits, taxes and charges are assessed, but nothing in this part shall be construed as creating any obligation on the state of Utah to pay any of said charges or taxes.
