(a) All persons subject to this chapter shall secure all public property taken from the enemy for the service of the United States, and shall give notice and turn over to the proper authority without delay all captured or abandoned property in their possession, custody, or control.

(b) Any person subject to this chapter who—

(1) fails to carry out the duties prescribed in subsection (a);

(2) buys, sells, trades, or in any way deals in or disposes of captured or abandoned property, whereby he receives or expects any profit, benefit, or advantage to himself or another directly or indirectly connected with himself; or

(3) engages in looting or pillaging;


shall be punished as a court-martial may direct.

Pub. L. 114–328, div. E, title LX, §§5401(4), (7), 5414, title LXIII, §5542, Dec. 23, 2016, 130 Stat. 2938, 2944, 2967, provided that, effective on the date designated by the President, not later than the first day of the first calendar month beginning two years after Dec. 23, 2016, with implementing regulations prescribed by the President not later than one year after Dec. 23, 2016, and with provisions relating to applicability to various situations, this section is redesignated and transferred to become section 908a of this title (article 108a), and section 906 of this title (article 106) is redesignated and transferred to become this section and further amended. For text of section 903 after such transfer and amendment on the effective date, see Amendment of Analysis and Subchapter note preceding section 877 of this title.

EFFECTIVE DATE OF 2016 AMENDMENT

Transfers and amendment by Pub. L. 114–328 effective on the date designated by the President, not later than the first day of the first calendar month beginning two years after Dec. 23, 2016, with implementing regulations prescribed by the President not later than one year after Dec. 23, 2016, and with provisions relating to applicability to various situations, see section 5542 of Pub. L. 114–328, set out as a note under section 801 of this title.
