§424. Conditional supervisory control of Retirement Home Board by Secretary of Defense (a) Applicability

This section shall apply only when the deduction authorized by section 1007(i)(1) of title 37 to be made from the monthly pay of certain members of the armed forces is equal to .00 for each enlisted member, warrant officer, and limited duty officer of the armed forces on active duty.

(b) Board authority subject to Secretary's control

The Retirement Home Board shall be subject to the authority, direction, and control of the Secretary of Defense in the performance of the Board's duties under section 416 of this title.

(c) Appointment of Board members

When an appointment of a member of the Retirement Home Board under section 415 of this title is not made by the Secretary of Defense, the appointment shall be subject to the approval of the Secretary of Defense.

(d) Terms of Board members

(1) Notwithstanding section 415(e)(3) of this title, only the Secretary of Defense may appoint a member of the Retirement Home Board for a second consecutive term.

(2) The Secretary of Defense may terminate the appointment of a member of the Retirement Home Board at the pleasure of the Secretary.

(e) Responsibility of chairman to the Secretary

Notwithstanding section 415(d)(1)(B) of this title, the chairman of the Retirement Home Board shall be responsible to the Secretary of Defense, but not to the Secretaries of the military departments, for direction and management of the Retirement Home or each facility maintained as a separate facility of the Retirement Home.
