§3509. Annual report on advisory councils (a) Submission to Congress; contents

Not later than March 31 of each calendar year after 1970, the Secretary of the Department of Health and Human Services shall submit a report on the activities of advisory councils (established or organized pursuant to any applicable statute of the Public Health Service Act, as amended [42 U.S.C. 201 et seq.], or the Mental Retardation Facilities and Community Mental Health Centers Construction Act of 1963, as amended [42 U.S.C. 2689 et seq., 6000 et seq.]) to the Committee on Labor and Human Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives. Such report shall contain, at least, a list of all such advisory councils, the names and occupations of their members, a description of the function of each advisory council, and a statement of the dates of the meetings of each advisory council.

(b) Recommendations by Secretary

If the Secretary determines that a statutory advisory council is not needed or that the functions of two or more statutory advisory councils should be combined, he shall include in the report a recommendation that such advisory council be abolished or that such functions be combined.

(c) “Statutory advisory council” defined

As used in this section, the term “statutory advisory council” means any committee, board, commission, council, or other similar group established or organized pursuant to any applicable statute to advise and make recommendations with respect to the administration or improvement of an applicable program or other related matter.

The Mental Retardation Facilities and Community Mental Health Centers Construction Act of 1963, as amended, referred to in subsec. (a), is Pub. L. 88–164, Oct. 31, 1963, 77 Stat. 282, as amended, which is classified principally to chapter 75 (§6000 et seq.) of this title. Title II of that Act, which was also known as the Community Mental Health Centers Act and was classified principally to subchapter III (§2689 et seq.) of chapter 33 of this title, was repealed by Pub. Amendments

1994—Subsec. (a). Pub. L. 103–437 substituted “Labor and Human Resources” for “Labor and Public Welfare” and “Energy and Commerce” for “Interstate and Foreign Commerce”.

Change of Name

“Secretary of the Department of Health and Human Services” substituted for “Secretary of the Department of Health, Education, and Welfare” in subsec. (a) pursuant to section 509(b) of Pub. L. 96–88, which is classified to section 3508(b) of Title 20, Education.

Committee on Energy and Commerce of House of Representatives treated as referring to Committee on Commerce of House of Representatives by section 1(a) of Pub. L. 104–14, set out as a note preceding section 21 of Title 2, The Congress.

Termination of Advisory Councils

Pub. L. 93–641, §6, Jan. 4, 1975, 88 Stat. 2275, set out as a note under section 217a of this title, provided that an advisory committee established pursuant to the Public Health Service Act or the Mental Retardation Facilities and Community Mental Health Centers Construction Act of 1963 shall terminate at such time as may be specifically prescribed by an Act of Congress enacted after Jan. 4, 1975.
