CHAPTER 437. REPORTING REQUIREMENTS
§ 437.001. AWARD FILING. (a) If an arbitration award is filed in a court of competent jurisdiction in this state, the filer shall also, not later than the 30th day after the date an award is made in a residential construction arbitration, file with the commission a summary of the arbitration award that includes: (1) the names of the parties to the dispute; (2) the name of each party's attorney, if any; (3) the name of the arbitrator who conducted the arbitration; (4) the name of the arbitration services provider who administered the arbitration, if any; (5) the fee charged to conduct the arbitration; (6) a general statement of each issue in dispute; (7) the arbitrator's determination, including the party that prevailed in each issue in dispute and the amount of any monetary award; and (8) the date of the arbitrator's award. (b) The commission shall establish rules to permit the voluntary filing of the information listed in Subsection (a) by any interested party. Any agreement prohibiting the disclosure of the information listed in Subsection (a) is unenforceable. Added by Acts 2003, 78th Leg., ch. 458, § 1.01, eff. Sept. 1, 2003. § 437.002. ENFORCEMENT. (a) The commission by rule shall establish a fee not to exceed $100 for the late filing of an arbitration award and procedures for the collection of that fee. (b) A party to an arbitration, or an attorney for a party, may report an overdue filing of an arbitration award to the commission. Added by Acts 2003, 78th Leg., ch. 458, § 1.01, eff. Sept. 1, 2003.
