CHAPTER 429. APPEAL OF THIRD-PARTY INSPECTOR'S RECOMMENDATION
§ 429.001. APPEAL. (a) A homeowner or builder may appeal a third- party inspector's recommendation on or before the 15th day after the date the recommendation is issued. (b) If a homeowner or builder appeals a third-party inspector's recommendation, the executive director shall appoint three state inspectors to a panel to review the recommendation. If the recommendation involves a dispute regarding a structural failure, one of the state inspectors on the panel must be a licensed professional engineer. (c) The panel shall: (1) review the recommendation without a hearing unless a hearing is otherwise required by rules adopted by the commission; (2) approve, reject, or modify the recommendation of the third-party inspector or remand the dispute for further action by the third-party inspector; and (3) issue written findings of fact and a ruling on the appeal not later than the 30th day after the date the notice of appeal is filed with the commission.
