CHAPTER 45. STORAGE PERMIT
§ 45.01. AUTHORIZED ACTIVITIES. The holder of a storage permit may store liquor in a public bonded warehouse for which a permit has been issued or in a private warehouse owned and operated by the holder. Amended by Acts 1983, 68th Leg., p. 1349, ch. 278, § 35, eff. Sept. 1, 1983. § 45.03. ELIGIBILITY FOR PERMIT; RESTRICTIONS; EXCEPTIONS. (a) A storage permit may be issued to a holder of a brewer's, distiller's and rectifier's, winery, wholesaler's, class B wholesaler's, or wine bottler's permit. (b) A permit must be obtained for each place of storage. (c) Except as provided by this subsection, a storage permit may not be issued for a location outside the county in which the permittee's business is located. Subject to Section 45.04, the holder of a winery permit may obtain a storage permit for a location inside or outside the county in which the permit holder's business is located. (d) Except as provided by Section 45.04 of this code, no storage permit may be issued for a location in a dry area. (e) A permit is not required for the storage of stock in trade on the licensed premises. Acts 1977, 65th Leg., p. 458, ch. 194, § 1, eff. Sept. 1, 1977. A holder of a winery permit whose winery is located in a county all or part of which is in a dry area may obtain a storage permit to store the winery's product in a dry area of that county if: (1) the holder of the winery permit obtains a permit for each place of storage; and (2) the product to be stored is owned by the holder of the winery permit and remains in the possession of the holder.
