  • (a) If a person is convicted of parentage fraud, as described in § 39-14-111, then the judge or jury must ascertain the value of any child support paid by the victim in reliance upon the parentage fraud, and the court must order the defendant to pay restitution of that value of child support to the victim, if not previously restored to the victim.
  • (b) To the extent permitted by federal law, a victim of parentage fraud may bring a cause of action to recover other financial support made in reliance upon the parentage fraud.
