- The administrator of a nursing home may refuse access to the facility to any person whose presence would be injurious to the health and safety of a resident or the staff, or would threaten the security or the property of the residents, staff or facility.

- Any person refused access to a nursing home shall be notified at the time of the refusal of the person's right to file a complaint with the department, which may require the facility to answer as to its reasons.
- Counseling residents regarding their legal rights shall not constitute an activity justifying denial of access.
