§ 68-102-126. Penalty for Failure to Comply With Order

- Any owner or occupant failing to comply with an order pursuant to § 68-102-117 within thirty (30) days after the order has been made final commits a Class C misdemeanor for each day's neglect thereafter. An action may be brought in any court having jurisdiction, including the court of general sessions of the county in which the property is located, in the name of the state of Tennessee, upon the relation of the commissioner of commerce and insurance.
- If defective or unlawful conditions, as defined in § 68-102-117 have resulted from the failure of any architect, contractor, builder, mechanic, electrician or other person to comply with the requirements of laws and regulations relating to the installation of facilities, appliances and equipment for the use of electrical energy or gas (natural, artificial or liquid petroleum) in any building, structure or on premises located in this state, then the architect, contractor, builder, mechanic, electrician or other person shall be required to comply with any order or orders issued by an officer or inspector insofar as the order or orders may relate to the failure. Upon failure to comply with the order or orders within thirty (30) days, the architect, builder, contractor, mechanic, electrician or other person commits a Class C misdemeanor.
