§ 68-11-812. Notice that violation is or may constitute basis of suspension of admissions or civil monetary penalty.

  • (a) Upon finding a violation that is, or may be, the basis of a suspension of admissions, as provided in § 68-11-252, or that is, or may be, the basis of a civil monetary penalty as set forth in §§ 68-11-801 — 68-11-805, the department inspector shall orally and in writing advise the nursing home of the findings before concluding the inspection or investigation. The written notification shall include an acknowledgement of both the findings and the state or federal penalties that could result from the findings.

  • (b) As soon as practicable after the department inspector advises the nursing home of finding a violation that is, or may be, the basis of a suspension of admissions, as provided in § 68-11-252, or that is, or may be, the basis of a civil monetary penalty as set forth in §§ 68-11-801 — 68-11-805, the commissioner shall provide notice of the apparent violation to the members of the senate and house of representatives of the general assembly in whose district the nursing home is located.
