62-9-102. Scrap metal dealer registration Declaration by registrant whether ever convicted of violations or offenses involving scrap metal Prohibition against registering for period of time after conviction.

(a)  No scrap metal dealer shall purchase, deal or otherwise engage in the scrap metal business unless the dealer is registered with the department. All registrations under this chapter shall expire two (2) years from the date of the registration or the renewal of the registration. The commissioner of commerce and insurance may promulgate and adopt rules and regulations that are reasonably necessary to carry out this chapter. The commissioner shall establish registration and renewal fees that are adequate to cover the administrative costs associated with the registration program.

(b)  Included on each registration and renewal form shall be a section in which the registrant must declare, under penalty of perjury pursuant to § 39-16-702(a)(3), whether the registrant has ever been convicted of a violation of this chapter or convicted of the criminal offense of theft, burglary or vandalism, where the offense involves scrap metal.

(c)  An applicant who has been convicted of a violation of this chapter or has a conviction for the criminal offense of theft, burglary or vandalism, where the offense involves scrap metal, shall be prohibited from registering under this chapter for five (5) years from the date of conviction.
