36-5-1108. Rulemaking authority.

The department has authority to promulgate rules pursuant to the Uniform Administrative Procedures Act, compiled in title 4, chapter 5, that it determines are necessary for the implementation of this part, and it is specifically authorized to utilize public necessity rules to implement this part, effective June 23, 1997, subject to prior approval of the public necessity rules by the attorney general and reporter.
