37-10A-1. Alcoholic beverages not to be sold below wholesale cost--Exception--"Wholesale cost" defined. Alcoholic beverages may not be sold below the wholesale cost of such alcoholic beverages, unless the sale constitutes the termination of the sale of the alcoholic beverage on the licensed premises. Alcoholic beverages offered for sale at less than wholesale cost may not be offered again for sale on the licensed premises for a period of less than one year after termination of the sale of said product on the licensed premises. Wholesale cost is the consideration paid by a retailer to a wholesaler to acquire alcoholic beverages and includes but is not limited to the purchase price and freight charges.
