58-42-12. Submission of information to director--Time for approving or disapproving form or rate--Extension in writing--Written notice of disapproval--Hearing. The director may require the submission of whatever relevant information is reasonably necessary in determining whether to approve or disapprove a filing made under § 58-42-9 or 58-42-11.

The director shall, within thirty days after receiving a filing under § 58-42-9 or 58-42-11, inform the person making the filing whether the director approves or disapproves the form or rate. The director may extend the period for an additional thirty days by notice in writing to the person making the filing prior to the expiration of the first thirty days. A notice of disapproval shall be in writing and shall state the reasons for disapproval.

If the director does not disapprove a filing within the period specified in this section, the filing is deemed approved. The director may disapprove any form or rate that has previously been approved or disapproved.

The director shall grant a hearing within thirty days after receipt in writing by any person aggrieved by the director's decision.
