Section 31-29-63.1 - Notice to owner to remove nonconforming sign--Removal by department at owner's expense.
31-29-63.1. Notice to owner to remove nonconforming sign--Removal by department at owner's expense. Any advertising sign, display, or device which violates the provisions of this chapter is hereby declared to be unlawful. The Department of Transportation shall give thirty days' written notice by certified mail, to the owner thereof to remove any prohibited sign, display, or device. If the owner fails to act within the thirty days as required by the notice, the department shall cause the sign, display or device to be removed at the owner's expense. If, for any reason, the department is unable to collect the removal costs, it may institute the necessary legal proceedings to recover them.Source: SL 1979, ch 202, § 18; SL 1987, ch 210, § 15.
