Section 31-12-34 - Secondary township highway construction by county--Petition--Election.
31-12-34. Secondary township highway construction by county--Petition--Election. When ten or more resident freehold voters from a township in a county shall, with the permission of the county commissioners, join in a petition to the county commissioners of a county asking such board to construct and maintain all secondary highways in such township, such petition shall be filed with the county auditor in said county and such board shall order an election for the purpose of determining by a vote of the voters of such township or may submit at any general election, the question of such county maintaining, improving, and constructing the secondary highways of such township.Source: SL 1959, ch 145, § 1; SDC Supp 1960, § 28.0417.
