     35-10-10.   Unstamped beverages as contraband--Confiscation and sale--Disposition of proceeds. When any alcoholic beverage is imported into this state or held in the possession of any person in this state without proper stamps thereon in violation of the provisions of the statutes of this state, such alcoholic beverage is hereby declared to be contraband goods and may be seized by the secretary, his agents, employees, or any law enforcement officer of the state. Any alcoholic beverage seized under the provisions of this section shall be confiscated and forfeited to the state. The actual owner of such goods shall have such rights as defined, and the secretary may dispose of, sell, or destroy, such contraband goods in accordance with the provisions of §§ 35-10-11 to 35-10-16, inclusive. The proceeds of any such sale shall be placed in the general fund of the state.
