§ 34-14-4 Failure of person joined as plaintiff to appear. – If any person named as plaintiff without his or her consent neglects to appear, after being duly notified in such manner as the court shall direct, his or her name shall be stricken from the writ and pleadings, and the other persons named as plaintiffs may prosecute the action to final judgment and execution in their own names and for their own use.
