§ 3021. Definitions

The following terms or words shall have the meaning stated below, except where the context clearly states otherwise, and the words used in singular shall also include the plural and vice versa:

(a) Department.— Department of Agriculture of Puerto Rico.(b) Import.— The act of bringing or introducing poultry meat or poultry products that were produced outside of Puerto Rico.(c) License.— Document issued by the Department of Agriculture of Puerto Rico authorizing the import, storage, marketing, distribution, sale, and handling of poultry meat or poultry products at the wholesale level in Puerto Rico.(d) Marketing.— To import, deliver, negotiate, sell, offer for sale, resell, supply, provide, exchange, or otherwise store, handle, or distribute poultry meat or poultry products.(e) Person.— Any natural or juridical person, whether or not for profit, as well as associations, cooperatives, partnerships, trusts, or any other juridical entity registered and authorized to do business in accordance with the laws of the Commonwealth of Puerto Rico.(f) Fresh poultry.— Means any poultry meat or poultry products marketed in Puerto Rico whose internal temperature does not exceed the limits established in Title 9 CFR - Chapter III - Subchapter A - Part 381.129(6)(i), as amended, that is, whose internal temperature has never been below 26 degrees Fahrenheit, but may deviate below 26°F by two (2) degrees in commerce, that is, never below 24° Fahrenheit per unit and the average temperature of lots shall never be below 26° Fahrenheit, and has never been frozen or thawed.(g) PPIA.— The Poultry Products Inspection Act, 21 USC, section 451, et seq., as amended.(h) Promotion.— Advertising a product to make it publicly known.(i) Regulations.— Market Regulation No. 8, Regulation No. 8274, as amended, known as the “Regulations to Govern the Quality and Marketing of Poultry Meat,” of the Department of Agriculture of Puerto Rico.(j) Secretary.— Means the Secretary of the Department of Agriculture of Puerto Rico or his authorized representative.(k) USD.— United States Department of Agriculture.
