§ 136 - Organic products certifier—Requirements

A certifier shall use a sufficient number of inspectors to implement the certification program, as determined through regulations. The certifier shall also keep a register of all activities pursuant to this chapter for a term of not less than ten years, which shall not be disclosed to third parties, except to the Secretary or the officials of the Department. These registries shall be delivered to the Department in case of death, dissolution, or loss of accreditation due to noncompliance. An authorized certifier of organic products shall not have a conflict of interest with operation he/she certifies, accept any type of gift or emolument, or provide assessment related to organic practices for any compensation, except what is established by the Secretary through regulations.
