Chapter 106 - Act to Manage the Agricultural Practices in the Commonwealth of Puerto Rico (§§ 4721 — 4726)
§ 4721. Definitions
(a) Agronomist.— Any person to whom the Puerto Rico Examining Board for Candidates to the Practice of Agronomy and Agronomist has issued a license for rendering professional services such as: advisory, consultation, education, training, appraisal, valuation, financing, oversight, inspection, and certification in connection with the rendering of public or private agricultural services, as well as the development of agricultural businesses, products, and services, among others.
(b) Department.— The Department of Agriculture of the Commonwealth of Puerto Rico.
(c) Secretary.— The Secretary of Department of Agriculture of the Commonwealth of Puerto Rico or his or her duly authorized representative.
(d) Farmer.— Any natural or juridical person engaged in farming, the cultivation of land, animal husbandry, that is, the practice of raising animals, and the production of flowers, plants, and ornamental grasses on a commercial scale.
(e) Bona fide farmer.— Any natural or juridical person who holds a valid certification issued by the Secretary of Agriculture attesting, that during said year, such person was engaged in the exploitation of an agricultural business and derives fifty percent (50%) or more of his or her gross income from an agricultural business as an operator, owner, or lessee, as stated in his or her income tax return.
(f) Agricultural practices.— Means clearing the land of trees, palm trees, bushes and underbrush, reforestation, plowing, raking, earth filling, soil removal, terracing, land leveling, building paths, ditches, ponds, watering troughs, greenhouses, plant nurseries, ranches, sheds, canals, and the installation of pipes for irrigation and drainage systems; it includes the cleaning and maintenance thereof.
(g) Underbrush.— A generic term used to classify or group plants that, at a given time and place, and in a determined number, are a nuisance, harmful, or undesirable for cultivation.
(h) New farm.— Soil grouped under the same user that has never been cultivated, or that has been resting or fallowing for ten (10) years or more.
