§ 5311. Incendio

- Toda persona que a propósito, con conocimiento o temerariamente ponga en peligro la vida, salud o integridad física de las personas al prender fuego a un edificio o propiedad, será sancionada con pena de reclusión por un término fijo de ocho (8) años. Si la persona convicta es una persona jurídica será sancionada con pena de multa hasta treinta mil dólares ($30,000).
- Para constituir un incendio no será necesario que el edificio o la propiedad quede destruida, bastando que se haya prendido en fuego, de modo que prenda en cualquier parte del material del mismo.
- El tribunal también podrá imponer la pena de restitución.
