§ 1130a. Muertes simultáneas

- Cuando el asegurado y el beneficiario o beneficiarios en una póliza de vida o de incapacidad fallecen, y no hay evidencia de cuál de ellos premurió al otro o a los demás, la póliza se pagará de acuerdo con sus términos, como si el beneficiario o los beneficiarios hubiesen premuerto al asegurado. Ninguna regla de evidencia relativa a muertes simultáneas será aplicable a casos cubiertos por esta sección.
- Será válido un convenio entre las partes incluido en la póliza mediante el cual el asegurado determine que los beneficios de la póliza se pagarán a otros beneficiarios en vez de a los herederos del asegurado en casos de muerte simultánea cubiertos por esta sección.
