Act 8 - CONVEYANCE - MULTIPLE CONVEYANCES IN MULTIPLE COUNTIES AND REPEALS

An Act

 

Authorizing the Department of General Services, with the approval of the Pennsylvania Historical and Museum Commission and the Governor, to grant and convey certain easements through and across lands of the Commonwealth of Pennsylvania in the Township of Manheim, County of Lancaster, for purposes of a road realignment project and to accept from the Township of Manheim existing right-of-way to be abandoned as part of the road realignment project; authorizing the Department of General Services, with the approval of the Department of Military and Veterans Affairs and the Governor, to grant and convey to Drexel University, permanent easement encumbering certain lands situate in the City and County of Philadelphia; authorizing the Department of General Services, with the approval of the Governor, to grant and convey to the City of Philadelphia certain land, buildings and improvements situated in the 40th ward of the City of Philadelphia, Philadelphia County; authorizing the release of Project 70 restrictions on certain land owned by Lower Salford Township, Montgomery County, in return for the development of a hiking trail and scenic viewing area in Lower Salford Township, Montgomery County; revoking a use restriction; and making repeals.

 

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

 

Section 1.  Conveyance of easements at the Landis Valley Museum.

(a)  Authorization.--The Department of General Services, with the approval of the Pennsylvania Historical and Museum Commission and the Governor, is hereby authorized on behalf of the Commonwealth of Pennsylvania to grant and convey the following easements, at the Landis Valley Museum, situate in the Township of Manheim, County of Lancaster, to the Township of Manheim for $1, for purposes of a road realignment project.

(b)  Property description.--The property to be conveyed under subsection (a) consists of the following easements, situate in the Township of Manheim, County of Lancaster, bounded and more particularly described as follows:

Right-of-Way Easement #1

BEGINNING at a point on line of lands now or formerly of David Costello, said point also being the eastern right of way line of East Delp Road (realigned), a 60 foot side public street, being located

N 17°37'11" W 57.37 feet from a rebar at the southwest corner of lands now or formerly of

The Commonwealth of Pennsylvania; extending thence along lands now or formerly of David Costello and crossing over East Delp Road (realigned)  N 17°37'11" W for a distance of 88.61 feet to a point on the western right of way line of East Delp Road (realigned); extending thence along said last mentioned right of way line the following two (2) courses and distances, namely: (1) N 24°59'27" E for a distance of 39.89 feet to a point; (2) N 17°44'06" W for a distance of 55.93 feet to a point on the southern legal right of way line of Landis Valley Road (S.R. 1014), a 60 foot wide public street; extending thence along said last mentioned legal right of way line by a curve to the right having a radius of 644.05 feet for a distance of 129.86 feet, the chord of which is S 57°35'50" E for a distance of 129.64 feet to a point on the eastern right of way line of East Delp Road (realigned); extending thence along said last mentioned right of way line the following two (2) courses and distances, namely: (1) S 72°21'51" W for a distance of 41.61 feet to a point; (2) S 24°59'27" W for a distance of 101.29 feet to a point and the place of BEGINNING.

Right-of-Way Easement #2

BEGINNING at a point on the eastern right of way line of Kissel Hill Road and on line of lands now or formerly of The Commonwealth of Pennsylvania, said point being located S 88°37'57" E 104.20 feet from the northwest corner of lands now or formerly of The Commonwealth of Pennsylvania

(UPI NO. 390-11002-0-0000); extending thence along other lands now or formerly of

The Commonwealth of Pennsylvania S 88°37'57" E for a distance of 63.05 feet to a point on the eastern right of way line of Kissel Hill Road (realigned); extending thence along said last mentioned right of way line S 18°56'16" E for a distance of 75.04 feet to a point on the northern legal right of way line of Landis Valley Road (S.R. 1014), a 60 foot wide public street; extending thence along said last mentioned legal right of way line by a curve to the left having a radius of 704.44 feet for a distance of 100.16 feet, the chord of which is N 55°53'31" W for a distance of 100.07 feet to a point on the eastern right of way line of Kissel Hill Road; extending thence along said last mentioned right of way line N 15°27'36" W for a distance of 16.99 feet to a point and the place of BEGINNING.

(UPI NO. 390-53494-0-0000); extending thence along said last mentioned right of way line N 9°58'39" W for a distance of 12.51 feet to a point on the western right of way line of Kissel Hill Road (realigned); extending thence along said last mentioned right of way line the following two (2) courses and distances, namely: (1) N 78°56'12" E for a distance of 8.67 feet to a point; (2) by a curve to the left having a radius of 145.00 feet for a distance of 121.95 feet, the chord of which is N 3°26'47" W for a distance of 118.38 feet to a point on the eastern right of way line of Kissel Hill Road; extending thence along said last mentioned right of way line the following two (2) courses and distances, namely: (1) by a curve to the left having a radius of 260.00 feet for a distance of 35.29 feet, the chord of which is N 6°02'34" W for a distance of 35.26 feet to a point; (2) N 9°55'51" W for a distance of 241.40 feet to a point on the eastern right of way line of Kissel Hill Road (realigned); extending thence along said last mentioned right of way line the following four (4) courses and distances, namely: (1) by a curve to the left having a radius of 470.00 feet for a distance of 130.13 feet, the chord of which is S 17°51'45" E for a distance of 129.71 feet to a point; (2) S 25°47'39" E for a distance of 141.70 feet to a point; (3) by a curve to the right having a radius of 205.00 feet for a distance of 165.72 feet, the chord of which is S 2°33'07" E for a distance of 161.25 feet to a point; (4) S 13°27'19" E for a distance of 0.40 feet to a point on line of other lands now or formerly of The Commonwealth of Pennsylvania; extending thence along said last mentioned lands

BEGINNING at a rebar on the northern right of way line of East Delp Road (a 60 foot wide public street), said point being the southeast corner of lands now or formerly of David Costello; extending thence along said last mentioned lands N 17°37'11" W for a distance of 57.37 feet to a point on the eastern right of way line of East Delp Road (realigned), a 60 foot wide public street; extending thence along said last mentioned right of way line the following two (2) courses and distances, namely:

(2) N 74°21'12" E 92.47 feet; extending thence along the southern right of way line of East Delp Road

N 74°21'12" E for a distance of 61.75 feet to a point; extending thence through lands now or formerly of The Commonwealth of Pennsylvania the following three (3) courses and distances, namely:

(1) S 15°16'12" E for a distance of 25.26 feet to a point; (2) S 74°25'12" W for a distance of 61.75 feet to a point; (3) N 15°16'12" W for a distance of 25.19 feet to a point and the place of BEGINNING.

(c)  Authorization for acceptance of former right-of-way.--The Department of General Services, with the approval of the Pennsylvania Historical and Museum Commission and the Governor, is hereby authorized on behalf of the Commonwealth of Pennsylvania to accept the right-of-way described under subsection (d), to be abandoned by the Township of Manheim, at the Landis Valley Museum, situate in the Township of Manheim, County of Lancaster, to the Township of Manheim for $1.

(d)  Property description of former right-of-way.--The former right-of-way to be accepted pursuant to section 3 consists of the following, situate in the Township of Manheim, County of Lancaster, bounded and more particularly described as follows:

Former Right-of-Way

BEGINNING at a point on the northern right of way line of Kissel Hill Road, said point being located N 12°30'00" W 38.13 feet from the southwest corner of lands now or formerly of The Commonwealth of Pennsylvania (UPI No. 390-53494-0-0000); extending thence along said last mentioned right of way line N 64°58'26" E for a distance of 48.51 feet to a point on the western right of way line of Kissel Hill Road; extending thence along said last mentioned right of way line the following two (2) courses and distances, namely: (1) by a curve to the left having a radius of 187.81 feet for a distance of 87.55 feet, the chord of which is N 2°35'45" E for a distance of 86.76 feet to a point;

(e)  Easement agreement and deed of easement.--The documents to be executed by the Commonwealth of Pennsylvania pursuant to this section shall be executed by the Secretary of General Services in the name of the Commonwealth of Pennsylvania.

Section 2.  Conveyance in City and County of Philadelphia.

(a)  Authorization.--The Department of General Services, with the approval of the Department of Military and Veterans Affairs and the Governor, is authorized on behalf of the Commonwealth of Pennsylvania to grant to Drexel University a permanent easement encumbering the following tract of land, being the southern half of Cuthbert Street (vacated), located between 32nd Street and 33rd Street in the City and County of Philadelphia, under terms and conditions to be established in an easement agreement, which agreement shall include Drexel University's provision to the Commonwealth of Pennsylvania, its successors and assigns, in perpetuity, of 35 parking spaces for the exclusive use of the Commonwealth of Pennsylvania, its successors and assigns, as fee title owner of the property known as 3205-51 Lancaster Avenue, Philadelphia, Pennsylvania.

(b)  Property description.--The property to be encumbered by a permanent easement under subsection (a) consists of the following:

ALL THAT CERTAIN piece or parcel of land situate in the 24th Ward of the City of Philadelphia, County of Philadelphia, and Commonwealth of Pennsylvania, described according to a plan entitled "ALTA NSPS Land Title Survey" of property owned by land n/f Drexel University, prepared by Pennoni Associates, Inc., dated October 14, 2022, last revised June 5, 2023, Project GATDV21001,to wit:

BEGINNING at a point on the former centerline of the former Cuthbert Street (stricken from City Plan and vacated), said point being S 11 degrees 01 minutes 00 seconds W, a distance of 20.00 feet, from the intersection of the easterly line of lands n/f OPA 88-5498280 and the former northerly line of the aforementioned Cuthbert Street;  thence, from said point of beginning; (1)  through the bed of aforementioned Cuthbert Street, S 11 degrees 01 minutes 00 seconds W, a distance of 20.00', to a point in the northerly line of lands n/f of OPA 77-4520500, thence; (2) coincident with the same, N 78 degrees 59 minutes 00 seconds W, a distance of 283.00', to a point in the westerly line of lands of the same; thence; (3) departing said line through the bed of aforementioned Cuthbert Street, N 11 degrees 01 minutes 00 seconds E, a distance of 20.00', to a point on the former centerline of the aforementioned Cuthbert Street, thence; (4) coincident with the same, S 78 degrees 59 minutes 00 seconds E, a distance of 283.00', to the place and point of beginning.  Said above described tract or parcel of land containing with said bounds 5,660 square feet, or 0.12994 acres of land (more or less).

BEING a portion of OPA Account Number 774520500, known as 3205-51 Lancaster Avenue, Philadelphia, Pennsylvania.

(c)  Conditions.--The conveyance shall be made under and subject to all lawful and enforceable easements, servitudes and rights of others, including, but not confined to, streets, roadways and rights of any telephone, telegraph, water, electric, gas or pipeline companies, as well as under and subject to any lawful and enforceable estates or tenancies vested in third persons appearing of record, for any portion of the land or improvements erected thereon.

(d)  Deed of conveyance.--The conveyance shall be made by easement agreement to be executed by the Secretary of General Services in the name of the Commonwealth of Pennsylvania.

(e)  Expiration.--In the event that the conveyance authorized under subsection (a) is not completed within two years after the effective date of this subsection, the authority to convey the easement as specified under subsection (a) shall expire.

(f)  Proceeds.--The proceeds from the easement conveyance under this section shall be deposited into the General Fund.

Section 3.  Conveyance to City of Philadelphia.

(a)  Authorization.--The Department of General Services, with the approval of the Governor, is authorized on behalf of the Commonwealth of Pennsylvania to grant and convey, to the City of Philadelphia, the following tract of land, together with any buildings, structures or improvements thereon, situate in the 40th Ward of the City of Philadelphia, Philadelphia County, for $38,000,000 under terms and conditions to be established in an agreement of sale.

(b)  Property description.--The property to be conveyed under subsection (a) consists of a tract of land totaling approximately 18.837 acres, including all buildings, structures and improvements located thereon, more particularly described as follows:

ALL THAT CERTAIN tract or parcel of ground situated in the 40th Ward of the City of Philadelphia bounded and described in accordance with a plan thereof made by Maurice H. Goldich, Surveyor and Regulator of the Tenth Survey District, dated September 21, 1966, as follows:

BEGINNING at a point on the northwesterly side of Enterprise Avenue (70' wide) at the distance of 398' as measured N 60 degrees 46 minutes 26 seconds East along said northwesterly side of Enterprise Avenue from the point of intersection of the said side of Enterprise Avenue produced southwestwardly and the northeasterly side of Executive Avenue (60' wide) produced southeastwardly, said point of beginning being on the northeasterly line of a proposed right-of-way for an industrial railroad side track (agreement between City of Philadelphia and the Philadelphia Baltimore and Washington Railroad Company pending); thence extending along said northeasterly right-of-way line North 29 degrees 13 minutes 34 seconds West a distance of 836.394' to a point of curve; thence extending along a curve to the right having a radius of 335' subtending a central angle of 65 degrees 02 minutes 44 seconds an arc distance of 380.312' to a point of tangency, said point of tangency being on the southeasterly side of the clear zone of runway 4-22 Philadelphia International Airport; thence extending along said southeasterly side of the clear zone North 35 degrees 49 minutes 10 seconds East a distance of 355.147' to a point; thence extending North 72 degrees 21 minutes 25.45 seconds East a distance of 188.176' to a point on a property line of the City of Philadelphia (Southwest Sewage Treatment Works); thence extending along said property line and crossing the head of a right-of-way for sewer and drainage purposes South 29 degrees 13 minutes 34 seconds East a distance of 1252.172' to a point on the aforementioned northwesterly side of Enterprise Avenue; thence extending along the said side of Enterprise Avenue the following four (4) courses and distances:  (1) South 60 degrees 46 minutes 26 seconds West 6.325', (2) along a curve to the left having a radius of 100' subtending a central angle of 117 degrees 03 minutes 30.74 seconds and recrossing the head of the aforementioned right-of-way for sewer and drainage purposes and arc distance of 204.306' to a point of reverse curve, (3) extending along a curve to the right having a radius of 100' subtending a central angle of 47 degrees 32 minutes 45.08 seconds an arc distance of 82.983' to a point of tangency; (4) South 60 degrees 46 minutes 26 seconds West 452.436' to the first mentioned point and place of beginning.

CONTAINING 18.837 acres, more or less.

SUBJECT to a 60-foot-wide right-of-way for sewer and drainage purposes located in the Easternmost corner of the Premises adjacent to the Northeastern extremity of Enterprise Avenue.

BEING Tax Parcel No. 77-3-1025-00.

BEING the same premises the General State Authority conveyed to the Commonwealth of Pennsylvania, by deed dated July 11, 1997, and recorded August 29, 1997, in the Recorder of Deeds Office of Philadelphia County in Deed Book D 0398, Page 565.

(c)  Existing encumbrances.--The conveyance shall be made under and subject to all lawful and enforceable easements, servitudes and rights of others, including, but not confined to, streets, roadways and rights of any telephone, telegraph, water, electric, gas or pipeline companies, as well as under and subject to any lawful and enforceable estates or tenancies vested in third persons appearing of record, for any portion of the land or improvements erected thereon.

(d)  Conditions.--Any conveyance authorized under this section shall be made under and subject to the condition, which shall be contained in the deed of conveyance, that no portion of the property conveyed shall be used as a licensed facility, as defined in 4 Pa.C.S. § 1103 (relating to definitions), or any other similar type of facility authorized under State law. The condition shall be a covenant running with the land and shall be binding upon the grantee and its successors and assigns. Should the grantee, its successors or assigns permit any portion of the property authorized to be conveyed in this section to be used in violation of this subsection, the title shall immediately revert to and revest in the grantor.

(e)  Deed.--The conveyance shall be by special warranty deed to be executed by the Secretary of General Services in the name of the Commonwealth of Pennsylvania.

(f)  Costs and fees.--Costs and fees incidental to this conveyance shall be borne by the grantee.

(g)  Alternate disposition.--If the conveyance is not effectuated within two years after the effective date of this section, the property may be disposed of in accordance with section 2405-A of the act of April 9, 1929 (P.L.177, No.175), known as The Administrative Code of 1929.

(h)  Proceeds.--From the proceeds received by the Commonwealth from the conveyance authorized by this section, $10,000,000 shall be deposited into a restricted account in the General Fund. These proceeds to the restricted account are appropriated to the Department of General Services for the acquisition of land and for the design and construction of a new readiness center for the Department of Military and Veterans Affairs to be located in Philadelphia County. The remaining $28,000,000 of the proceeds received by the Commonwealth from the conveyance authorized by this section shall be deposited into the General Fund.

Section 4.  Partial release of restrictions on Bergey's Mill Park in Lower Salford Township, Montgomery County.

(a)  Authorization.--Pursuant to the requirements of section 20(b) of the act of June 22, 1964 (Sp.Sess. 1, P.L.131, No.8), known as the Project 70 Land Acquisition and Borrowing Act, the General Assembly approves the release of Project 70 restrictions from a portion of the land owned by Lower Salford Township, Montgomery County, which is more particularly described in subsection (c), in return for the development of a hiking trail and scenic viewing area described in subsection (b).

(b)  Consideration.--

(1)  Lower Salford Township intends to convey a right-of-way and easements as described in subsection (c) to Montgomery County for the Bergey's Mill Road bridge replacement project. To comply with Project 70 funding purposes of providing land for both "recreation and historical purposes" and "conservation purposes," Montgomery County shall, in exchange, construct approximately 755 linear feet of hiking trail and scenic viewing area within Bergey's Mill Park, according to a Park Master Trail Plan. The recreational trail and scenic overlook are anticipated to be constructed as part of the Bergey's Mill Road bridge project.

(2)  Within five years of the date of the conveyances described in subsection (c), Montgomery County shall construct the trail and scenic overlook at Bergey's Mill Park.

(c)  Land to be released from Project 70 restrictions.--The land to be released from Project 70 restrictions is as follows:

CONTAINING in area 5,115.4296 square feet or 0.117 acre more or less.

Section 5.  Revocation of use restriction on conveyance in the Borough of Wyoming, Luzerne County.

(b)  (Reserved).

Section 6.  Repeals.

Repeals are as follows:

(1)  The General Assembly declares that the repeal under paragraph (2) is necessary to effectuate section 5.

(2)  Section 9(e) of the act of June 10, 2022 (P.L.108, No.24), is repealed.

(3)  The General Assembly declares that the repeal under paragraph (4) is necessary to effectuate the land transfer in section 3 of this act.

(4)  Section 13 of the act of December 21, 1998 (P.L.1036, No.137), entitled "An act authorizing the Department of General Services, with the approval of the Governor, to sell and convey to Paul A.
