AN ACT

 

Amending Title 34 (Game) of the Pennsylvania Consolidated Statutes, in game or wildlife protection, further providing for the offense of unlawful taking and possession of protected birds and for endangered or threatened species.

 

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

 

Section 1.  Sections 2164(d) and 2167(d) of Title 34 of the Pennsylvania Consolidated Statutes are amended by adding paragraphs to read:

§ 2164.  Unlawful taking and possession of protected birds.

(d)  Penalties.--

(3)  Notwithstanding paragraphs (1) and (2), a violation of this section relating to birds listed under 16 U.S.C. § 668 (relating to bald and golden eagles) that results in the killing of a bald eagle or golden eagle is, in addition to any other penalties, a summary offense punishable by a fine of $2,000.

§ 2167.  Endangered or threatened species.

(d)  Penalties.--A violation of this section shall be graded as follows:

(4)  In addition to any other penalty, a violation of subsection (b) that results in the killing of a protected bird listed under 16 U.S.C. § 668 (relating to bald and golden eagles) shall be graded one degree higher than the penalty provided under paragraph (1), (2) or (3).

Section 2.  This act shall take effect in 60 days.
