Act 118 - LOCAL OPTION SMALL GAMES OF CHANCE ACT - REPORT AND DISTRIBUTION OF PROCEEDS

AN ACT

 

Amending the act of December 19, 1988 (P.L.1262, No.156), entitled "An act providing for the licensing of eligible organizations to conduct games of chance, for the licensing of persons to distribute games of chance, for the registration of manufacturers of games of chance, and for suspensions and revocations of licenses and permits; requiring records; providing for local referendum by electorate; and prescribing penalties," in club licensees, further providing for report and for distribution of proceeds.

 

The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows:

 

Section 1.  Section 501(a) of the act of December 19, 1988 (P.L.1262, No.156), known as the Local Option Small Games of Chance Act, is amended by adding a paragraph to read:

Section 501.  Club licensee.

(a)  Report.--

(3)  If a club licensee utilizes the proceeds for operating expenses as authorized under section 502(c), the report under paragraph (1) shall include the verification and itemization of the amounts utilized for the operating expenses.

Section 2.  Section 502 of the act is amended by adding a subsection to read:

Section 502.  Distribution of proceeds.

(c)  Disaster emergencies.--A club licensee may utilize the proceeds under subsection (a)(1) for operating expenses beginning with the 2020 calendar year through a period of one year after either of the following are terminated by executive order, proclamation or operation of law, whichever is later:

(1)  The proclamation of disaster emergency issued by the Governor on March 6, 2020, published at 50 Pa.B. 1644 (March 21, 2020).

(2)  A declaration of disaster emergency related to the novel coronavirus known as "COVID-19" that is issued after March 6, 2020.

Section 3.  This act shall take effect immediately.
