526 - Rejection of rate increase requests due to inadequate quality or quantity of service.

     § 526.  Rejection of rate increase requests due to inadequate
                quality or quantity of service.
        (a)  General rule.--The commission may reject, in whole or in
     part, a public utility's request to increase its rates where the
     commission concludes, after hearing, that the service rendered
     by the public utility is inadequate in that it fails to meet
     quantity or quality for the type of service provided.
        (b)  Other powers and duties preserved.--This section shall
     not be construed to diminish the powers and duties of the
     commission under any other provision of law to remedy inadequate
     service by a public utility.

        1986 Amendment.  Act 114 added section 526. Section 18
     provided that section 526 shall be applicable to all cases
     pending before the commission or courts, whether on appeal or
     otherwise.
