Chapter 448 - Pool Facilities; Water and Sewage Systems
Section 448.268 - Ground water quality concern area; recommendation to Environmental Quality Commission.

(1) If, as a result of its activities under ORS 448.150, or through the review of other relevant data, the Oregon Health Authority confirms the persistent and prevalent presence in ground water drinking water supplies of contaminants resulting at least in part from suspected nonpoint source activities, the authority shall recommend that the Environmental Quality Commission declare a ground water quality concern area. The declaration by the commission shall identify the substances confirmed in the ground water and ground water aquifers that may be affected.

(2) Before recommending that the commission declare a ground water quality concern area, the authority shall:

(a) Ensure that sample results utilized to develop the recommendation have been produced or verified by an accredited laboratory;

(b) Ensure that data and results utilized to develop the recommendation were collected in accordance with a quality assurance project plan or a similar document; and

(c) Submit to the commission, and make publicly available, the methodology utilized to evaluate the results and conduct the data evaluation that would cause the authority to make the recommendation. [1989 c.833 §32; 2009 c.595 §854; 2025 c.605 §22]
