Section 358.528 - Application for change from historic property special assessment to another program to be acted upon unless withdrawn.

When any property has been classified and specially assessed as historic property under ORS 358.480 to 358.545 and the owner or the owner’s legal representative applies for a change in the classification under another special assessment program, the applicant shall have 30 calendar days following the filing of the application within which to withdraw the application, by giving written notice to the public official or agency to whom the applicant applied for the change in classification. If no notice of withdrawal is given by the applicant, the application shall be acted upon and the change in classification made, as otherwise provided by law. Note: The amendments to 358.528 by section 11, chapter 209, Oregon Laws 2025, apply to applications for classification and special assessment under 358.480 to 358.545 filed on or after September 26, 2025, for property tax years beginning on or after July 1, 2026. See section 22, chapter 209, Oregon Laws 2025. The text that applies to applications for classification and special assessment under 358.480 to 358.545 filed before September 26, 2025, for property tax years beginning before July 1, 2026, is set forth for the user’s convenience.
