As used in the following statutes and any rule adopted under the following statutes, the term "controlled substance" does not include marijuana:
(1) ORS 475.125, 475.135, 475.145, 475.155 and 475.165.
(2) ORS 475.175, 475.185, 475.188 and 475.190.
