Section 443.045 - Denial, suspension and revocation of licenses; penalties.

OR Rev Stat § 443.045 (2015) What's This?

(1) The Oregon Health Authority may deny, suspend or revoke the license of, or assess a civil penalty against, any individual, home health agency or caregiver registry for failure to comply with ORS 443.004 or 443.014 to 443.105, or with the rules of the authority as authorized by ORS 443.085.

(2) License denials, suspensions and revocations, assessment of civil penalties, adoption of rules and judicial review thereof shall be in accordance with ORS chapter 183.

(3) A civil penalty imposed under this section may not exceed $1,000 per violation and may not total more than $2,000.

(4) All civil penalties recovered under this section shall be paid into the State Treasury and credited to the Oregon Health Authority Fund. Moneys credited to the fund under this section are continuously appropriated to the authority for the administration of ORS 443.014 to 443.105 and 443.305 to 443.350.
