Section 135.911 - Diversion for first offense only.

After the time for requesting a hearing under ORS 135.909 has expired with no request for a hearing, or after a hearing requested under ORS 135.909, the court shall allow the petition for a possession of marijuana diversion agreement if the court finds that the offense for which the defendant is before the court is the defendant’s first offense of possession of less than one ounce of marijuana.
