135.911 Diversion for first offense only.

After the time for requesting a hearing under ORS 135.909 has expired with no request for a hearing, or after a hearing requested under ORS 135.909, the court shall allow the petition for a possession of marijuana diversion agreement if the court finds that the offense for which the defendant is before the court is the defendant s first offense of possession of less than one ounce of marijuana. [1989 c.1075 7]
