398.391 Controlled substances.


OR Rev Stat § 398.391 (through Leg Sess 2011) What's This?

(1) Any person subject to this chapter who wrongfully uses, possesses, manufactures, distributes or introduces into an installation, vessel, vehicle or aircraft used by or under the control of the organized militia a substance described in subsection (2) of this section shall be punished as a court-martial may direct.

(2) The substances referred to in subsection (1) of this section are the following:

(a) Opium, heroin, cocaine, amphetamine, lysergic acid diethylamide, methamphetamine, phencyclidine, barbituric acid and marijuana and any compound or derivative of any such substance.

(b) Any other substance not specified in paragraph (a) of this subsection that is listed in schedules I to V of section 202 of the Controlled Substances Act (21 U.S.C. 812), as modified under ORS 475.035. [1985 c.682 3]
