398.130 Convening summary courts-martial.


OR Rev Stat § 398.130 (through Leg Sess 2011) What's This?

(1) In the organized militia not in federal service, the commanding officer of a garrison, fort, post, camp, air base, auxiliary air base or other place where troops are on duty, or of a brigade, regiment, wing, group, detached battalion, separate squadron or other detached command, may convene a summary court-martial.

(2) When only one commissioned officer is present with a command or detachment that officer shall be the summary court-martial of that command or detachment and shall hear and determine all summary court-martial cases. Summary courts-martial may, however, be convened in any case by superior competent authority when considered desirable by such authority. [1961 c.454 103; 1985 c.682 21]
