Title 63. Public Health and Safety
§63-429. Application of act – Destruction of plant parts not requiring medical marijuana waste disposal facility.

Universal Citation: 63 OK Stat § 429 (2022)

A. Medical marijuana waste shall be subject to the provisions of the Oklahoma Medical Marijuana Waste Management Act and shall not be subject to the provisions of the Uniform Controlled Dangerous Substances Act. Nothing in the Oklahoma Medical Marijuana Waste Management Act shall alter or affect the jurisdictional areas of environmental responsibility of the Department of Environmental Quality as provided for in Title 27A of the Oklahoma Statutes.

B. Commercial licensees, medical marijuana research facilities and medical marijuana education facilities shall be authorized to destroy the following marijuana plant parts without being required to utilize the services of a medical marijuana waste disposal facility:

1. Roots;

2. Stems;

3. Fan leaves;

4. Seeds; or

5. Stalks.

Unless restricted by local ordinance, commercial licensees, medical marijuana research facilities and medical marijuana education facilities shall be authorized to destroy the above-listed marijuana plant parts on-site by open burning, incineration, burying, mulching, composting or any other technique approved by the Department of Environmental Quality.
