§70-821.95. Criminal penalties.

A. An athlete agent who violates Section 821.94 of this title is guilty of a misdemeanor and, upon conviction, shall be subject to a fine of not less than Ten Thousand Dollars ($10,000.00) and not more than Two Hundred Fifty Thousand Dollars ($250,000.00), or by imprisonment not to exceed one (1) year, or by both such fine and imprisonment.

B. An athlete agent who violates Section 821.94 of this title upon a second or subsequent conviction shall be guilty of a felony and subject to a fine of not less than Fifty Thousand Dollars ($50,000) and not more than Five Hundred Thousand Dollars ($500,000), or by imprisonment not to exceed three (3) years, or by both such fine and imprisonment. All prior convictions in any state of acts that would constitute a violation under Section 821.94 of this title shall also constitute prior convictions under this section.

C. Fifty percent (50%) of all fines collected pursuant to this section shall be deposited in the Attorney General’s Law Enforcement Revolving Fund created in Section 19.1 of Title 74 of the Oklahoma Statutes.
