2113.46 [Effective Until1/13/2012] Who may discharge mortgage.


OH Rev Code § 2113.46 What's This?

In case of the redemption of a mortgage belonging to the estate of a decedent, the money paid thereon must be received by the executor or administrator and thereupon he shall release and discharge the mortgage. Until such redemption, the executor or administrator, if possession has been taken by him or by the decedent, shall be seized of the mortgaged premises in trust for the same persons who would be entitled to the money if the premises had been redeemed.

In case of the redemption of a mortgage belonging to the estate of a decedent, the money paid on the redemption shall be received by the executor or administrator, and the executor or administrator shall release and discharge the mortgage. Until that redemption, if the executor, administrator, or decedent has taken possession of the mortgaged premises, the executor or administrator shall be seized of the mortgaged premises in trust for the same persons who would be entitled to the money if the premises had been redeemed.
