§ 921.22. Pesticide program fund.
 

The pesticide program fund is hereby created in the state treasury. The portion of the money in the fund that is collected under this chapter shall be used to carry out the purposes of this chapter. The portion of the money in the fund that is collected under section 927.53 of the Revised Code shall be used to carry out the purposes specified in that section, the portion of the money in the fund that is collected under section 927.69 of the Revised Code shall be used to carry out the purposes specified in that section, and the portion of the money in the fund that is collected under section 927.701 of the Revised Code shall be used to carry out the purposes of that section. The fund shall consist of fees collected under sections 921.01 to 921.15, division (F) of section 927.53, and section 927.69 of the Revised Code, money collected under section 927.701 of the Revised Code, and all fines, penalties, costs, and damages, except court costs, that are collected by either the director of agriculture or the attorney general in consequence of any violation of this chapter.

The effective date is set by section 3.03 of H.B. 95 (150 v  - ). 

 

Effect of Amendments

H.B. 95, Acts 2003, effective July 1, 2004, substituted "The portion of the money" for "All money"; and inserted "that is collected under this chapter," and the present third sentence, "division (F) of section 927.53, and section 927.69" and "money collected under section 927.701 of the Revised Code." 

S.B. 217, Acts 2002, effective July 1, 2004, substituted "this chapter" for "sections 921.01 to 921.29 of the Revised Code. Not later than the thirtieth day of June of each year, the director of budget and management shall determine whether the amount credited to the pesticide program fund is in excess of the amount necessary to meet the expenses of the director of agriculture in administering this chapter and shall transfer any excess from the pesticide program fund to the general revenue fund"; and made minor stylistic changes.
