[§ 5126.02.29] § 5126.0229. Board employee may be member of governing board of political subdivision or agency.
As used in this section, "specialized services" has the same meaning as in
section 5126.281 [5126.28.1] of the Revised Code.
Notwithstanding any provision of the Revised Code to the contrary, including applicable provisions of
sections 102.03,
102.04,
2921.42, and
2921.43 of the Revised Code, an employee of a county board of mental retardation and developmental disabilities also may be a member of the governing board of a political subdivision, including the board of education of a school district, or an agency that does not provide specialized services. The county board may contract with such a governing board even though the governing board includes an individual who is an employee of the county board. That member of the governing board may not vote on any matter before the governing board concerning a contract with the county board or participate in any discussion or debate regarding such a contract.
