[§ 5112.31.1] § 5112.311. Adjustment of franchise permit fee.
If, under
section 5111.8816 [5111.88.16] of the Revised Code, the certified capacity of an intermediate care facility for the mentally retarded is reduced, the department of job and family services shall adjust the franchise permit fee the facility was assessed under
section 5112.31 of the Revised Code accordingly. If, under
section 5111.8811 [5111.88.11] of the Revised Code, the certified capacity of an intermediate care facility for the mentally retarded is increased, the department may adjust the franchise permit fee the facility was assessed under
section 5112.31 of the Revised Code accordingly.
